General information on the legal bases for data processing
Where you have consented to data processing, we process your personal data on the basis of Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR, where special categories of data under Art. 9 (1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, processing is additionally based on Art. 49 (1) (a) GDPR. Where you have consented to the storage of cookies or to access to information on your device, processing is additionally based on Section 25 (1) TDDDG. Consent can be withdrawn at any time. Where your data is required for the performance of a contract or for pre-contractual measures, we process your data on the basis of Art. 6 (1) (b) GDPR. We also process your data where this is necessary to fulfil a legal obligation, on the basis of Art. 6 (1) (c) GDPR. Processing may further be based on our legitimate interest under Art. 6 (1) (f) GDPR. The legal basis that applies in each individual case is set out in the following paragraphs of this privacy policy.
Recipients of personal data
In the course of our business activities we work with various external parties. In some cases this requires personal data to be transferred to those external parties. We only pass personal data on to external parties where this is necessary to perform a contract, where we are legally obliged to do so, for example when passing data to tax authorities, where we have a legitimate interest in the transfer under Art. 6 (1) (f) GDPR, or where another legal basis permits the transfer. Where processors are used, we pass on our customers' personal data only on the basis of a valid data processing agreement. Where processing is carried out jointly, a joint controllership agreement is concluded.
Withdrawing your consent to data processing
Many data processing operations are only possible with your explicit consent. You can withdraw consent you have already given at any time. The lawfulness of the processing carried out up to the point of withdrawal remains unaffected.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
IF DATA PROCESSING IS BASED ON ART. 6 (1) (E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS ARISING FROM YOUR PARTICULAR SITUATION. THIS ALSO APPLIES TO PROFILING BASED ON THOSE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21 (1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. THIS ALSO APPLIES TO PROFILING IN SO FAR AS IT IS CONNECTED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION UNDER ART. 21 (2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of the GDPR, data subjects have a right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged breach. This right to complain exists without prejudice to any other administrative or judicial remedy.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place in so far as it is technically feasible.
Information, correction and deletion
Within the scope of the applicable statutory provisions you have the right at any time to receive free information about your stored personal data, its origin and recipients and the purpose of the processing, and where applicable a right to have this data corrected or deleted. You can contact us at any time about this and about any further questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us about this at any time. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of the personal data we hold about you, we usually need time to verify this. For the duration of that check you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was or is unlawful, you can request the restriction of processing instead of deletion.
- If we no longer need your personal data but you need it to exercise, defend or establish legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
- If you have lodged an objection under Art. 21 (1) GDPR, a balance has to be struck between your interests and ours. As long as it has not been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, that data may, apart from being stored, only be processed with your consent or for the establishment, exercise or defence of legal claims, or to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.
SSL and TLS encryption
For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address bar of the browser changes from “http://” to “https://” and by the lock symbol in your browser bar. When encryption is active, the data you transmit to us cannot be read by third parties.
3. Hosting
Vercel
We host this website with Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. When you visit our website, your personal data is processed on the provider's servers. This can include your IP address, access times and further technical connection data.
This is based on Art. 6 (1) (f) GDPR. We have a legitimate interest in our website being presented as reliably and quickly as possible. Where corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG.
Data processing may also take place in the USA. The provider is certified under the EU-US Data Privacy Framework. A data processing agreement under Art. 28 GDPR is in place with the provider.
4. Data collection on this website
Server log files
The provider of this website automatically collects and stores information in so-called server log files, which your browser transmits to us automatically. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources. It is collected on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of the website, which requires server log files to be recorded.
Enquiries by email or phone
If you contact us by email or phone, your enquiry including all personal data arising from it will be stored and processed by us for the purpose of handling your request. We do not pass this data on without your consent.
This data is processed on the basis of Art. 6 (1) (b) GDPR where your enquiry is connected with the performance of a contract or is necessary for pre-contractual measures. In all other cases, processing is based on our legitimate interest in effectively handling the enquiries addressed to us under Art. 6 (1) (f) GDPR, or on your consent under Art. 6 (1) (a) GDPR where this has been requested.
The data you send us via a contact request remains with us until you ask us to delete it, withdraw your consent to its storage, or the purpose of storing it no longer applies. Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.
Requests through the first call form
When you send the first call form, we process what you enter there: first name, last name, email address, phone number, your goals, your profile and your description. We use it to prepare your first call and to contact you. The legal basis is Art. 6(1)(b) GDPR for pre-contractual steps and otherwise your consent under Art. 6(1)(a) GDPR.
First we send you a confirmation email with a link (double opt-in). Only after you click it does the request reach us by email. Until then your details are not stored on any server of ours. They only exist inside the signed link, which expires after 48 hours. Without your click nothing reaches us.
Both emails are sent through Resend, a service of Plus Five Five, Inc. (USA). Resend sends the emails from servers in Ireland (region eu-west-1). Processing in the USA cannot be ruled out. Details are in Resend's privacy policy: https://resend.com/legal/privacy-policy.
We keep the request in our mailbox until it is dealt with and no legal retention duty applies any more.
Storage in your browser
This website does not set any cookies. For two technical functions we use the session storage of your browser. There the website remembers whether the intro animation has already been shown in this session and which coaches you have selected in the coach finder.
This information stays on your device only and is not transmitted to us. It is deleted as soon as you close the browser tab. This storage is strictly necessary for the functions you have explicitly requested and takes place under Section 25 (2) no. 2 TDDDG.
No analytics or tracking tools
We do not use any tools on this website for audience measurement, for analysing user behaviour or for retargeting. Neither Google Analytics nor comparable services are embedded, and no advertising pixels are loaded.
5. Plugins and embedded content
YouTube
On individual pages we embed videos from YouTube. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
The videos are embedded so that the player itself is only loaded after a click on the preview. Only then does your browser establish a connection to YouTube's servers, and YouTube learns which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.
The preview image of a video is loaded from a Google server as soon as the page is opened. Your IP address is transmitted to Google in the process.
YouTube is used in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest under Art. 6 (1) (f) GDPR. Further information on how user data is handled can be found in Google's privacy policy at https://policies.google.com/privacy.
Spotify
On one athlete page we embed a podcast episode from Spotify. The provider is Spotify AB, Regeringsgatan 19, 111 53 Stockholm, Sweden. When this page is opened, a connection to Spotify's servers is established and Spotify learns which of our pages you have visited.
This is embedded in the interest of an appealing presentation of our online offerings and therefore on the basis of Art. 6 (1) (f) GDPR. Further information can be found in Spotify's privacy policy at https://www.spotify.com/legal/privacy-policy/.
Self-hosted fonts
This website uses fonts that we serve from our own server. There is no connection to Google Fonts servers or to other font providers, and no data is transmitted to third parties in the process.
Links to social networks
In the footer of our website we link to our profiles on Instagram, YouTube and TikTok. These are plain links without embedded content. Simply opening our website does not transmit any data to these networks. Only when you click one of these links do you leave our website, and the privacy policy of the respective provider applies.
